New York's veteran certification is service-disabled only
There is no filing fee break for veterans here. New York does run one of the stronger service-disabled veteran contracting programs in the country, with a goal written into statute, but a veteran without a qualifying VA rating cannot get into it at all.

New York gives veterans no discount on the $200 LLC filing fee, and its state veteran certification is open only to veterans with a VA service-connected disability rating of at least 10%.
Formation runs under N.Y. Ltd. Liab. Co. Law § 203 at the Department of State's standard fee, and the Department's Articles of Organization page lists no veteran waiver. What New York has instead is SDVOB certification through the Office of General Services, backed by a statewide participation goal for state contracts written into N.Y. Veterans' Services Law § 42. That is a statutory participation goal rather than a courtesy listing: it gives agency buyers a number they are measured against, but it is a goal, not a set-aside, and no business is entitled to any part of it. It is also the sharpest eligibility cliff in this cluster: with a qualifying rating, New York gives you a certification tied to a statutory participation goal; without one, the program is closed to you entirely.

Why New York Has No Veteran LLC Fee Waiver
Filing Articles of Organization under N.Y. Ltd. Liab. Co. Law § 203 costs the same whether or not you served. The Department of State's Articles of Organization page lists no veteran waiver and no reduced fee, and there is no application to fill out asking. A bill in the 2025-26 session, S.9624, would exempt veterans from certain business incorporation filing fees within five years of an honorable discharge, but it has been referred to the Senate Veterans, Homeland Security and Military Affairs Committee and gone no further. It is not law. Do not delay a filing waiting on it. Budget instead for the part of New York formation that actually hurts, which has nothing to do with veteran status: the publication requirement. Every New York LLC has to publish and then file a Certificate of Publication with its own fee, and depending on your county that package adds several hundred to a couple of thousand dollars on top of the filing fee. There is no veteran exemption from it. Ongoing costs are mild by comparison, since the Biennial Statement filed with the Department of State every two years in your formation anniversary month carries a small fee, again with no veteran exemption. One narrow break does exist outside the LLC system: under N.Y. Gen. Bus. Law § 32 a county clerk must issue a licence to hawk, peddle, vend or solicit trade without cost to a qualifying honorably discharged veteran. It is worth real money to a street vendor and worth nothing to anyone else, because it does not touch LLC filing fees, sales tax registration or professional licences.

Other New York Fees Veterans Do Not Pay
- County hawker/peddler/vendor licence only — the county clerk 'shall issue, without cost' a licence to hawk, peddle, vend or solicit trade to a qualifying honorably discharged veteran. It does not reach LLC filing fees, sales-tax registration or professional licences.: waived. N.Y. Gen. Bus. Law § 32 (veterans' exemption). Conditions include six months' residence in the county, production of the original discharge certificate or a certified copy, and a photograph taken within 30 days; the licence is valid only in the issuing county (or a city wholly embracing it), is non-transferable, and cities, villages and towns may still require their own local licence..

Check your rating first, before anything else
New York requires a VA service-connected disability rating of at least 10% for the veteran owners. This is a pass or fail gate at the front of the process, so confirm your current rating letter before you assemble anything else. National Guard members are verified through the New York Division of Veterans' Affairs rather than the VA.

Document ownership, control and size
You need at least 51% ownership by the qualifying veterans, and they must run the business day to day rather than hold it passively. The company also has to stay at or under 300 employees and show a significant business presence in New York. Get your operating agreement, resolutions and payroll records lined up to prove all four points at once.

Certification is handled by the Office of General Services, Division of Service-Disabled Veterans' Business Development, which can be reached at 518-474-2015. Neither the OGS certification page nor the Department of Veterans' Services page publishes an application fee, so confirm cost directly with the division rather than trusting a figure you read elsewhere.

Sell into the goal once you are certified
N.Y. Veterans' Services Law § 42 sets a statewide participation goal for certified SDVOB firms on state contracts, which gives agency purchasing staff a number they are measured against. That makes certification worth actively marketing: get in front of agency SDVOB liaisons and prime contractors who need to show subcontract participation, rather than waiting for the directory listing to work on its own.

State Benefits vs Federal Benefits — What Is Actually Different
Most of what gets published as “veteran LLC benefits in New York” is actually federal, and identical in all 50 states. Three separate things get run together:

Certification is worth doing on its own merits, but it is not a discount on formation. If a page tells you New Yorkgives veterans a “free LLC” and then links you to a certification portal, it has conflated the first row with the second.

Start with the Office of General Services, Division of Service-Disabled Veterans' Business Development at 518-474-2015, which both runs certification and is the office agencies answer to on participation. The New York State Department of Veterans' Services publishes a plain-language version of the same program rules and is a reasonable second call if you want the eligibility criteria explained before you apply. For the free hawker, peddler and vendor licence under Gen. Bus. Law § 32, go to your county clerk directly, and bring your original discharge certificate or a certified copy, proof of six months' residence in the county, and a photograph taken within the last 30 days.
