9. DMCA Takedown Procedure

Post-Earth Holdings LLC respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we have designated an agent to receive notices of alleged copyright infringement. If you believe in good faith that your copyrighted work has been copied in a way that constitutes infringement on this Site, please send a written notice to our DMCA agent containing all of the following:

  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material claimed to be infringing and its location on the Site;

10. Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES INDIVIDUAL ARBITRATION OF DISPUTES RATHER THAN JURY TRIALS OR CLASS ACTIONS.

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE — INCLUDING QUESTIONS OF ARBITRABILITY — SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS (“JAMS”) UNDER ITS STREAMLINED ARBITRATION RULES AND PROCEDURES THEN IN EFFECT. The arbitration shall be conducted by a single neutral arbitrator. The seat of arbitration shall be Newark, New Jersey, though the arbitration may be conducted remotely at either party's election. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Either party may seek emergency interim injunctive relief in a court of competent jurisdiction pending arbitration without waiving the right to arbitrate. Claims of $10,000 or less may, at the claimant's election, be resolved through the JAMS Small Claims procedure. Nothing in these Terms prevents you from bringing individual claims in small claims court where jurisdiction permits.

11. Class Action Waiver

YOU AND POST-EARTH HOLDINGS LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN ANY CLASS OR COLLECTIVE ACTION. Neither you nor MyStateLLC may be a representative or member of any class of claimants with respect to any claim related to the Site.

12. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles. For any dispute not subject to arbitration under Section 10, or for purposes of enforcing an arbitration award, you consent to the exclusive jurisdiction of the state and federal courts located in Essex County, New Jersey. You agree to bring any claim within one (1) year of when it arose, or it is permanently waived.

13. Indemnification

You agree to indemnify, defend, and hold harmless Post-Earth Holdings LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Site or violation of these Terms.

14. Accelerator Program Terms

The MyStateLLC Accelerator program (“Accelerator”) accepts applications from early-stage founders. By submitting an application, you acknowledge and agree that:

  • Submission of an application does not guarantee acceptance or any commitment from MyStateLLC;
  • Application materials (including business descriptions and contact information) are collected and stored by MyStateLLC for the purpose of evaluating applications and, if accepted, operating the program;
  • MyStateLLC reserves the right to accept or decline any application at its sole discretion and without explanation;
  • MyStateLLC is not responsible for business outcomes, decisions made in reliance on program materials, or any loss arising from participation in or exclusion from the Accelerator.

Application data is handled in accordance with our Privacy Policy.

15. Attorney Reviewer Program Terms

Licensed attorneys who apply to review MyStateLLC content (“Legal Reviewers”) agree that:

  • Participation is voluntary and does not create an employment, contractor, or agency relationship with Post-Earth Holdings LLC;
  • Legal Reviewers are independent professionals providing general accuracy feedback on educational content — not legal advice to MyStateLLC or its users;
  • MyStateLLC may display the reviewer's name, bar state, and firm website on the Legal Reviewers page. Reviewers may request removal at any time by contacting contact@mystatellc.com;
  • MyStateLLC does not guarantee that submitted review feedback will be incorporated into site content;
  • Application data is handled in accordance with our Privacy Policy.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
