LLC Guide

Mississippi excludes eBay's own sales from your nexus number. What happens next isn't published.

The nexus math is clear and favorable, and the state's 1099 reporting simply follows the federal test. Registration, resale paperwork, and secondhand-dealer licensing are questions Mississippi's own guidance doesn't answer, and this page won't guess at them either.

We could not confirm Mississippi's position on whether a marketplace-only seller must register. Mississippi excludes marketplace-facilitated sales when measuring your own $250,000 threshold — your eBay sales do not count against it. Mississippi uses the federal reporting threshold, so eBay issues a 1099-K once you pass $20,000 and 200 transactions. See the sources below.

The Bottom Line for Mississippi eBay Sellers

An LLC doesn't change what Mississippi's Department of Revenue has actually published about an eBay seller, and on three real questions, it hasn't published much of anything. What is genuinely clear favors a marketplace-only seller: Mississippi attributes a facilitated sale to eBay's own nexus count, not yours, and its 1099 reporting simply mirrors the federal rule. Whether you need your own registration, what resale documentation a Mississippi wholesaler will actually accept, and whether reselling used goods triggers a licensing requirement are all open questions this page can't responsibly answer for you, because the state hasn't answered them itself in anything a researcher could find and read directly.

Mississippi's 2020 marketplace-facilitator legislation amended the state's doing-business definition to attribute a marketplace-facilitated sale to the facilitator's own threshold, not the seller's, direct statutory text, unambiguous. The Department of Revenue's own 1099 guidance separately states plainly that Mississippi follows the federal determination for 1099-K. Neither the Department's site nor the state's compiled code, however, contains a marketplace-seller registration FAQ, a resale-certificate rule addressing out-of-state sellers, or a general secondhand-dealer statute that a genuine search could locate, and a business-tax blog's assertion about any of those, without a matching primary source, isn't something this page will repeat as fact.

We could not confirm Mississippi's position on whether a marketplace-only seller must register. Mississippi excludes marketplace-facilitated sales when measuring your own $250,000 threshold — your eBay sales do not count against it. Mississippi uses the federal reporting threshold, so eBay issues a 1099-K once you pass $20,000 and 200 transactions.

eBay Collects Mississippi Sales Tax. What Is Still Yours?

We could not confirm Mississippi's position on whether a marketplace-only seller must register.

The registration question for a marketplace-only Mississippi eBay seller doesn't have a published answer this page can point to. The Department's marketplace-facilitator materials define who counts as a facilitator and address the 2020 law's effect on the state's own doing-business threshold, but they don't say in plain language whether a seller whose only Mississippi sales run through a registered facilitator still needs a permit of their own. Rather than infer an answer from silence, the honest move is to call the Department of Revenue directly and get their position in writing before you decide you don't need to register. Especially before you add any sales channel eBay isn't collecting for.

Do Your eBay Sales Count Toward Mississippi's Nexus Test?

Mississippi excludes marketplace-facilitated sales when measuring your own $250,000 threshold — your eBay sales do not count against it.

This part of Mississippi's rule is genuinely settled and favorable: a sale a marketplace facilitator makes on your behalf counts toward the facilitator's own threshold, not yours, under the state's marketplace-facilitator law. An eBay-only seller effectively never builds toward Mississippi's own economic-nexus number through eBay activity alone, no matter how much volume moves through the platform. That protection only covers the marketplace column, though, any direct Mississippi sale you make off eBay, or through a channel that doesn't collect Mississippi tax on your behalf, counts toward your own total the way it would in any other state, so keep that separate ledger regardless of how clean the marketplace side looks.

Mississippi's 1099-K Threshold

Mississippi uses the federal reporting threshold, so eBay issues a 1099-K once you pass $20,000 and 200 transactions.

Mississippi's Department of Revenue states its own reporting position plainly: it follows the federal government's determination of when a 1099-K exists, rather than setting an independent state figure. That means the practical trigger for when eBay reports your Mississippi activity is whatever the federal test currently requires, nothing lower and nothing state-specific layered on top. When the form does arrive, treat it as a report of gross payment volume, not a bill, reconciling it against fees, refunds, and cost of goods to find your actual taxable profit is a bookkeeping exercise best done inside your LLC's own records rather than a personal account mixed with unrelated spending.

Buying Inventory to Resell in Mississippi

We could not confirm how Mississippi treats an out-of-state resale certificate.

Genuine effort could not confirm this; Mississippi's sales-for-resale mechanics appear to run through DOR verification of a Mississippi sales tax permit number rather than a standard written 'resale certificate,' but no primary source could be reached that states whether an out-of-state seller's own state permit is accepted in lieu of Mississippi registration.

Whether a Mississippi wholesaler will accept an out-of-state resale certificate, or insists on Mississippi's own permit-verification process instead, is a question this research couldn't answer from a source worth trusting, the state's sales-tax statutes establish that a person doing business in Mississippi needs a Department of Revenue permit, but say nothing directly about what a seller may accept from an out-of-state buyer claiming resale. The same is true of secondhand-goods licensing: Mississippi's pawnshop and precious-items statutes are narrow carve-outs that don't reach ordinary used-merchandise resale, but no general secondhand-dealer statute could be confirmed to exist or confirmed not to. If your business depends on either answer, a Mississippi supplier requiring proof, or volume reselling of used goods. Get it from the Department of Revenue or a Mississippi attorney directly rather than relying on general guidance.

We could not confirm Mississippi's second-hand dealer licensing. Mississippi Code Title 75 contains chapter 67 (pawnshops, licensed via the state Dept. of Banking and Consumer Finance - a pawnbroker carve-out) and chapter 95 ('Business of Purchasing Precious Items for Resale' - a precious-items carve-out), both of which are out of scope under the scoping rule since they don't reach general resale of ordinary used goods. No general statewide secondhand-dealer licensing statute (of the kind Massachusetts/Michigan/Minnesota have) could be located or ruled out with a citation, so this is left unverified rather than guessed as 'none.'

Setting Up to Sell on eBay from Mississippi

  1. Call the Department of Revenue before assuming you don't need a permit

Mississippi hasn't published a clear answer on marketplace-only seller registration. Get the state's own position before deciding it doesn't apply to you.

  2. Form the LLC regardless of how the open questions resolve

The entity protects you from liability that has nothing to do with sales-tax registration, and it's worth having in place while you sort out the rest.

  3. Track your direct Mississippi sales separately

eBay-facilitated sales count toward the platform's own threshold, not yours, but any direct sale you make off eBay counts toward your own total the ordinary way.

  4. Confirm resale documentation with each Mississippi wholesaler directly

No general rule could be confirmed, so ask each supplier what they'll accept before assuming your home-state certificate works.

  5. Ask about secondhand-dealer licensing before reselling used goods at volume

No general statute could be confirmed to exist or not exist. Get a direct answer from the Department of Revenue rather than assuming state silence means nothing applies.

What We Could Not Confirm for Mississippi

These pages only state what a primary source establishes. For Mississippi we could not confirm the following, so this page does not answer it:

  • whether a marketplace-only seller must register
  • whether an out-of-state resale certificate is accepted
  • whether a statewide reseller licence applies

Who to Ask in Mississippi

The Mississippi Department of Revenue is the office to call for the registration, resale-documentation, and secondhand-dealer questions this page couldn't resolve, asking directly and getting an answer in writing is the right move given the gaps in published guidance. The Mississippi Secretary of State's office is where your LLC itself gets filed and maintained. Neither office publishes a marketplace-seller FAQ as detailed as some neighboring states', so a direct phone call or written request is likely to get you further than searching their websites will.

Federal 1099-K threshold: IRC § 6050W(e), as amended by § 70432(a) of the One, Big, Beautiful Bill Act (P.L. 119-21, July 4, 2025). A third-party settlement organization such as eBay must file Form 1099-K only if BOTH tests are met for the calendar year: gross payments exceed $20,000 AND the number of transactions exceeds 200. These are the figures for tax year 2026. There is no forward phase-in: § 70432(a) takes effect "as if included in section 9674 of the American Rescue Plan Act," so the same $20,000 / 200 figures apply retroactively to calendar years after 2021 (tax years 2022 through 2026 alike). The $600 threshold enacted by ARPA § 9674 (P.L. 117-2) was repealed before it operated, and the IRS transition-relief thresholds previously announced for 2024 and 2025 are superseded. A platform may issue a 1099-K below these figures, and a state may set a lower TPSO threshold, in which case a seller can receive a 1099-K without meeting the federal test.. Verified 2026-08-08.
