Nebraska charges veterans the full LLC filing fee

No waiver, no discount, no state certification. What Nebraska does offer is one narrow tie-breaker on state contracts, and it's worth knowing exactly how narrow it is.

Nebraska gives veterans no break on the $100 LLC filing fee, and there's no state veteran-owned business certification to apply for.

The Secretary of State's fee schedule and the Nebraska Uniform Limited Liability Company Act contain no veteran exemption of any kind. The biennial report is the same for you as for anyone else. The single veteran business provision in Nebraska law is a bid preference under Neb. Rev. Stat. § 73-107, and it only breaks ties — it isn't a percentage credit and it isn't a set-aside.

Why Nebraska Has No Veteran LLC Fee Waiver

Filing a Certificate of Organization costs a veteran what it costs everybody. Filing online is cheaper than filing in the office, which is the only discount available here, and the online figure isn't quite the whole story either — Nebraska.gov adds a portal charge on top that the Secretary of State doesn't publish alongside the filing fee. Plan on paying slightly more at checkout than the posted number. The cost that surprises people isn't a state fee at all. Nebraska still requires a newly formed LLC to publish a notice of organization in a legal newspaper, and that bill goes to the newspaper, not the state. There is no veteran exemption from it, the price swings with which county and which paper you use, and it lands on top of the filing fee. Then there's the biennial report: every domestic and foreign LLC files one between January 1 and April 1 of each odd-numbered year under Neb. Rev. Stat. § 21-125, with no veteran reduction written into the statute or the fee schedule.

Veteran-Owned Business Certification in Nebraska

Nebraska does not run its own veteran-owned business certification. That means there is no state certificate to apply for — but it also means the federal certification is the one that matters, and it is free.

The SBA’s VetCert program certifies Veteran-Owned Small Businesses (VOSB) and Service-Disabled Veteran-Owned Small Businesses (SDVOSB) for federal contracting. Certification is free and is handled entirely at veterans.certify.sba.gov.

Other Nebraska Programs for Veteran Business Owners

Nebraska's only veteran business benefit is small, and pretending otherwise would waste your time. It matters in one specific moment — when a state contract comes down to a tie.

  • Tie-breaker bid preference for a resident disabled veteran: When a Nebraska state contract is to be awarded to the lowest responsible bidder, a resident disabled veteran is allowed a preference over any other resident or nonresident bidder if all other factors are equal. A 'resident disabled veteran' must live in Nebraska, have been discharged or separated under honorable or general (under honorable conditions) conditions, hold a VA or DoD service-connected disability determination, and own and control the business (or own more than 50 percent of the stock of a publicly owned business) and control its management and daily operations. Most of what gets published as “veteran LLC benefits in Nebraska” is actually federal, and identical in all 50 states. Three separate things get run together:

Certification is worth doing on its own merits, but it is not a discount on formation. If a page tells you Nebraskagives veterans a “free LLC” and then links you to a certification portal, it has conflated the first row with the second.

The Nebraska Department of Veterans' Affairs is the state agency to start with; its staff and county veterans service officers handle benefits questions, and NDVA also tracks veteran-related legislation each session, which is where any future filing-fee bill would first show up. For the filing itself, the Secretary of State's Business Services division publishes the current fee schedule and is the only reliable source on what you'll actually pay. If you're chasing state contracts, the § 73-107 preference is applied through the procuring agency at bid evaluation, not through any certification office.
