Filing Fees & Formation Costs

Arizona charges $50 to form an LLC, while West Virginia charges $100. Arizona is $50 cheaper upfront. The cost that usually gets overlooked: if you form in West Virginia but operate in Arizona, you must also register as a foreign LLC in Arizona (a $150 filing) and maintain a registered agent in West Virginia (typically around $150 per year). Note that Arizona also requires newly formed LLCs to publish a newspaper notice (Arizona requires a notice of the filing to be published for three consecutive publications in a newspaper in the county of the statutory agent's address, unless that county's population exceeds 800,000, currently Maricopa and Pima, in which case the Corporation Commission posts the notice itself, free of charge), which adds to the true formation cost.
