Practically, this cuts two ways depending on how you actually operate. A seller who lists exclusively on eBay, ships from home, and never buys inventory through a Georgia-registered supplier is asking a question Georgia hasn't clearly answered, the state's guidance covers the marketplace's own collection duty in detail but doesn't say whether that relieves the individual seller of registering separately. That changes the moment you also sell through your own website, a local pop-up, or any channel eBay isn't collecting for, because Georgia's dealer-registration duty clearly attaches to the seller for those sales regardless of what a marketplace does elsewhere. If your LLC will ever ship on a Facebook Marketplace deal or a craft-fair table alongside the eBay listings, get the registration question answered before that first non-eBay sale rather than after.
Do Your eBay Sales Count Toward Georgia's Nexus Test?

The practical planning question is different: not whether your eBay volume alone triggers something, but whether your household or business also runs sales through channels the marketplace rule was never written to cover. Georgia's 1099-K Threshold

A 1099-K arriving doesn't, by itself, tell you anything new about what you owe Georgia. It's an information return to the IRS, not a state tax bill. What it does is put your gross payment volume in writing somewhere the state and federal government can both see it, which is exactly why sellers who have been informally reselling as a hobby often discover the LLC conversation only after that first form shows up. Reconciling the 1099-K gross figure against your actual net proceeds (cost of goods, eBay and payment-processor fees, returns), is the step that turns a scary-looking form into an accurate number, and it's easier to do inside a business entity with its own books than inside a personal bank account mixed with everything else.
Buying Inventory to Resell in Georgia
Georgia will not accept an out-of-state resale certificate, buying inventory tax-free here means holding a Georgia permit of your own.
Georgia's default resale exemption (Form ST-5, headed 'GEORGIA PURCHASER') calls for a Georgia sales and use tax number. The only pathway for a seller with no Georgia registration is Form ST-4 ('Certificate of Exemption, Out of State Purchaser'), which lets a purchaser certify it is licensed/registered in another state (giving that state's tax ID) and buy tax-free for resale, but only if the purchaser has no other Georgia sales presence and the property 'will be removed from the State of Georgia immediately after purchase.' It is not a blanket acceptance of any out-of-state resale certificate for general Georgia resale activity.
For a Georgia-based reseller who buys from out-of-state wholesalers or liquidation lots, this means your supplier will often ask for a Georgia registration number before extending resale pricing, even though the actual selling happens on a national marketplace. It's a common surprise for sellers who assumed a business license or an LLC filing alone would unlock wholesale accounts. Vendors are checking for the state's own resale documentation, not your entity paperwork. Georgia has no statewide secondhand-dealer licensing scheme reaching ordinary resale of used goods, so a seller flipping thrifted or garage-sale inventory isn't layering a separate licensing requirement on top of the sales-tax question, unlike states that regulate general resellers as pawn-adjacent dealers.
Georgia has no statewide second-hand dealer licence reaching general resale. Georgia's two dealer-in-used-property statutes are both narrow. Pawnbrokers are governed by O.C.G.A. Title 44, Chapter 12, Article 3, Part 5 (loans secured by pledged property), and licensing there is a municipal option, not a state mandate: 'municipal authorities may license pawnbrokers[ and] define powers and privileges by ordinance' (O.C.G.A. § 44-12-136), permissive local control of a loan-based business, not general resale. Separately, O.C.G.A. Title 43, Chapter 37 licenses 'dealer[s] in precious metals or gems' (persons purchasing precious metals/gems or goods made from them from the public), a classic narrow carve-out under the scoping rule, not general secondhand goods. No dedicated Georgia statute for general secondhand-goods dealers (clothing, electronics, general merchandise resale) was found in Title 43 or Title 44; an online reseller of ordinary used goods falls outside both the pawnbroker and precious-metals frameworks.
Setting Up to Sell on eBay from Georgia
Separate marketplace sales from everything else you sell
Before anything else, write down every channel you sell through, eBay, any other marketplace, your own site, in person. Georgia's marketplace-facilitator rule only reaches the eBay column; every other column is a separate question this page can't answer for you.
Form the LLC before volume grows, not after
The entity is what stands between a returns dispute or a supplier contract and your personal assets. Filing it while your eBay store is still small is cheaper in every sense than retrofitting a business structure onto years of transaction history.

Federal 1099-K threshold: IRC § 6050W(e), as amended by § 70432(a) of the One, Big, Beautiful Bill Act (P.L. 119-21, July 4, 2025). A third-party settlement organization such as eBay must file Form 1099-K only if BOTH tests are met for the calendar year: gross payments exceed $20,000 AND the number of transactions exceeds 200. These are the figures for tax year 2026. There is no forward phase-in: § 70432(a) takes effect "as if included in section 9674 of the American Rescue Plan Act," so the same $20,000 / 200 figures apply retroactively to calendar years after 2021 (tax years 2022 through 2026 alike). The $600 threshold enacted by ARPA § 9674 (P.L. 117-2) was repealed before it operated, and the IRS transition-relief thresholds previously announced for 2024 and 2025 are superseded. A platform may issue a 1099-K below these figures, and a state may set a lower TPSO threshold, in which case a seller can receive a 1099-K without meeting the federal test.. Verified 2026-08-08.
