Does a contracting business need a license in South Carolina?
South Carolina issues the General Contractor License and the Residential Builder License for general contractors.
South Carolina runs two schemes and the lower one binds first. The Residential Builders Commission licenses a residential builder once the cost of the undertaking exceeds $5,000 under S.C. Code 40-59-20, and the Contractor's Licensing Board licenses general contracting once the total cost of construction is greater than $10,000 under S.C. Code 40-11-30, a figure raised from $5,000 by 2023 Act No. 69. A residential specialty contractor registers once its undertakings exceed $500.
The contracting business itself must be licensed or registered, not only the people doing the work.
Under S.C. Code 40-11-20 a licensee is an entity that has been issued a general or mechanical contractor's license, and an applicant may be a limited liability company or corporation registered with the Secretary of State. The separate residential builder license is the opposite: S.C. Code chapter 40-59 provides that no license to practice residential home building may be held by a firm, so an LLC building houses works through a licensed individual in responsible charge.
