Does a contracting business need a license in Massachusetts?
Massachusetts issues the Home Improvement Contractor Registration and the Construction Supervisor License for general contractors.
Massachusetts requires any contractor or subcontractor performing residential contracting on a pre-existing owner occupied building of one to four dwelling units to be registered as a Home Improvement Contractor with the Office of Consumer Affairs and Business Regulation, with no dollar floor on the registration itself. A separate written contract requirement in General Laws c.142A, s.2 applies to agreements above $1,000. General Laws c.143, s.94(i) separately authorizes the Board of Building Regulations and Standards to issue Construction Supervisor Licenses, and those are issued to individuals rather than to companies.
The contracting business itself must be licensed or registered, not only the people doing the work.
The contracting business itself registers. General Laws c.142A, s.9(c) addresses registration by a corporation or partnership, which must designate an individual responsible for the entity's work, and makes the entity and that designee jointly and severally liable.

What the LLC has to do first
Where the state licenses the company rather than only the individual, the LLC has to exist before the license application can name it.
The entity filing is separate from anything the license requires. In Massachusetts it is made with the Massachusetts Secretary of the Commonwealth, Corporations Division.
