This is Colorado's genuine gap, worth naming plainly rather than filling in with a guess: nothing in Colorado's tax statutes or Department of Revenue guidance mentions Form 1099-K, third-party settlement organizations, or the federal reporting statute those forms come from. What Colorado's 1099 framework does address is withholding; a form gets transmitted to the state when Colorado income tax was withheld on the payment, a criterion that essentially never applies to a marketplace's payout to a seller. In practice that likely means no separate Colorado filing, but it's an inference from an unrelated framework rather than a direct statement, and that distinction matters if your situation is anything but ordinary eBay selling.

Buying Inventory to Resell in Colorado

Colorado accepts a resale certificate issued by another state, so you can buy inventory for resale without registering here first.

Colorado has no state-specific numbered resale certificate of its own; it accepts either another state's sales tax license or an exemption certificate issued by another state to document a resale exemption, and recommends (but the GIL indicates does not strictly require) using the Multistate Tax Commission's Uniform Sales & Use Tax Certificate, Multijurisdiction (Colorado Form DR 0563) as the vehicle for doing so.

Colorado doesn't issue its own numbered resale certificate at all; it accepts a sales tax license or exemption certificate from another state as documentation of a resale exemption, with the Multistate Tax Commission's uniform certificate recommended, though not strictly required, as the paperwork vehicle. That's a genuinely open door for a reseller already registered somewhere else. On the secondhand side, Colorado sets a statewide baseline: dealers report transactions to local law enforcement within a short window regardless of where they operate, but actual licensing is left to individual cities and counties to adopt or skip, so whether you need a local secondhand-dealer license depends entirely on where you're based. A Colorado supplier unfamiliar with the MTC certificate may simply ask for a Colorado account number out of habit; showing them the GIL's language directly, rather than just presenting the out-of-state certificate on its own, tends to resolve that faster than a back-and-forth.

Colorado leaves second-hand dealer licensing to cities and counties, so check your own. A third-party settlement organization such as eBay must file Form 1099-K only if BOTH tests are met for the calendar year: gross payments exceed $20,000 AND the number of transactions exceeds 200. These are the figures for tax year 2026. There is no forward phase-in: § 70432(a) takes effect "as if included in section 9674 of the American Rescue Plan Act," so the same $20,000 / 200 figures apply retroactively to calendar years after 2021 (tax years 2022 through 2026 alike). The $600 threshold enacted by ARPA § 9674 (P.L. 117-2) was repealed before it operated, and the IRS transition-relief thresholds previously announced for 2024 and 2025 are superseded.
