Wisconsin's Veterans Fee Waiver Is Real. It Doesn't Cover Your LLC.

Wis. Stat. § 45.44 waives initial licence fees across more than a dozen state agencies, and one of them is the same department that files your articles of organization. An entity filing still isn't a licence.

No free LLC: Wisconsin veterans pay the standard articles-of-organization fee of $130 online or $170 on paper, because the § 45.44 veterans fee waiver covers initial occupational and professional licences, not business entity filings.

The confusion here is structural rather than careless. The Department of Financial Institutions appears on the § 45.44 list of licensing agencies, and DFI is also where you file to organize an LLC, so a headline saying DFI waives fees for veterans reads as free LLC unless you already know that an LLC organized under Wis. Stat. ch. 183 is an entity filing and not a licence. DFI's own published fee schedule has no veteran line against any corporation or LLC filing. What Wisconsin does offer a veteran business owner is Disabled Veteran-Owned Business certification through the Department of Administration, and that route requires a service-connected disability.

Why Wisconsin Has No Veteran LLC Fee Waiver

Wis. Stat. § 183.0122(2)(a)1 sets the articles-of-organization fee, and DFI's schedule prices paper filing higher than online filing. Nothing on that schedule bends for military service, for a discharge document, or for a disability rating. The annual report is the same: no veteran exemption anywhere in the DFI fee schedule for any LLC or corporation filing. The waiver you read about deserves to be understood on its own terms, because it is genuinely valuable when you need a licence to do the work. Section 45.44 waives the fee for an initial licence from a list of state licensing agencies, and § 440.05 carries the same result through the professional credential fee schedule, including an initial reciprocal credential. The limits are real: it is for Wisconsin residents, it is essentially one-time, an applicant who has already had a waiver and comes back for another credential pays a fraction of the standard fee rather than nothing, and examination fees are never waived. If you are forming an LLC to do licensed work, the waiver may well cover your licence. It will not cover the filing that creates the company.

  • Initial occupational, professional and other state licence fees — the veterans fee waiver program covers initial licences issued by 13 licensing agencies including the Departments of Safety and Professional Services, Financial Institutions, Agriculture Trade and Consumer Protection, Revenue, Natural Resources, Transportation, Workforce Development, Health Services, Children and Families and Public Instruction, plus the Office of the Commissioner of Insurance, the Ethics Commission, the Board of Commissioners of Public Lands and the Supreme Court. It does NOT cover LLC formation or annual report fees.: waived. Wis. Stat. § 45.44 ('If the department verifies that the applicant for a license is eligible for a fee waiver, the licensing agency or the supreme court shall waive the accompanying fee for the license.') and Wis. Stat. § 440.05 ('no fee is required under this paragraph for an individual who is eligible for the veterans fee waiver program'; the same waiver applies to an initial reciprocal credential)..

    Decide which programme you actually want

    DVB certification through the Department of Administration is the one that has procurement consequences. The Department of Veterans Affairs logo is a marketing designation with no bidding rights attached. Plenty of applicants pick the easier one and then wonder why it does nothing for them in state purchasing.

    Check the DVB tests before you gather paper

    Wis. Stat. § 16.283 and Wis. Adm. Code ch. Adm 82 set the eligibility rules: majority ownership by disabled veterans who are Wisconsin residents with a VA service-connected disability rating, and a Wisconsin-headquartered business. Confirm both the ownership and the headquarters test first. An out-of-state business will not become eligible by adding a Wisconsin registered agent.

    Apply to the Wisconsin Supplier Diversity Program at DOA

    DOA administers DVB certification. Ask about cost when you make contact: no fee provision appears in ch. Adm 82 or § 16.283, and the department's certification page was unreachable when we checked, so we cannot tell you certification is free and would rather say that than guess. Have your VA rating documentation and ownership records assembled before you start.

    Request the veteran-owned business logo separately if you want it

    The Department of Veterans Affairs handles the logo and asks for ownership documentation plus a DD-214 for each veteran owner. It is a separate application to a separate department and it carries no procurement preference. Treat it as a marketing asset for your website and vehicles rather than a bidding credential.

Certification is worth doing on its own merits, but it is not a discount on formation. If a page tells you Wisconsingives veterans a “free LLC” and then links you to a certification portal, it has conflated the first row with the second.
