Does a contracting business need a license in Montana?
Montana issues the Construction Contractor License for general contractors on work valued above $2,500.
Montana licenses construction contractors under Title 37, chapter 45 of the Montana Code Annotated, administered by the Department of Labor and Industry. The former Title 39, chapter 9 contractor registration scheme was renumbered and repealed by Chapter 644, Laws of 2025. MCA 37-45-104(8) exempts casual, minor or inconsequential work on one undertaking whose aggregate contract price for labor, materials and all other items is less than $2,500 a job, and that exemption fails where a larger operation is divided into smaller contracts.
The contracting business itself must be licensed or registered, not only the people doing the work.
MCA 37-45-201 applies to an individual or a business entity, and the application for a limited liability company names the manager of a manager managed company or the members of a member managed company plus the registered agent.

What the LLC has to do first
Where the state licenses the company rather than only the individual, the LLC has to exist before the license application can name it.
The entity filing is separate from anything the license requires. In Montana it is made with the Montana Secretary of State. File directly with the state here.
