Does a contracting business need a license in Delaware?
Delaware issues the Contractor Business License for general contractors.
Delaware requires a contractor to hold a state contractor business license issued by the Division of Revenue before executing a contract, at a fee of $75, and the requirement carries no minimum contract value. The license is an occupational and gross receipts licensing measure under Title 30 rather than a competency examination, and trades such as electrical and plumbing are licensed separately by the Division of Professional Regulation. Local jurisdictions impose their own permit and licensing requirements.
The contracting business itself must be licensed or registered, not only the people doing the work.
30 Del. C. 2502(a) requires any person desiring to engage in business in the state as a contractor to obtain the license, and "person" reaches the business entity that contracts, whether resident or non-resident.
